Green Paper shall become a subject

The European Union of Rechtspfleger took part at the meeting of the Justice Forum of the European Commission, General Direction for Justice, Liberty and Security on 16 October 2009. The subject was „The Economic Crisis: What can be done in the justice field?” The economic crisis has reached the justice, because a lot of proceedings in the fields of enforcement, judicial sale, insolvency, land register, business register and European orders of payment procedure, will not only occupy the Rechtspfleger in Germany, but also the judges in other countries.

Because of many proceedings the courts will be overloaded in the next couple of years. In order to avoid a backlog Kappl, the President of the E.U.R., had suggested at the justice forum to introduce the European Rechtspfleger to discharge the judges. He referred to the Green Paper for a European Rechtspfleger. With the Green Paper a judicial profession shall be created alongside judges for Europe. Kappl handed over the Green Paper to the General Director of the General Direction for justice, freedom and security, Jonathan Faull. Faull agreed the proposal, that the Green Paper will become a subject in the justice forum.

During the further discussion Kappl suggested, to introduce a European Business Register in all countries of the EU. Insolvencies can be mentioned in the European Business Register. There is no need for an European Insolvency Register.

To accelerate the civil proceedings Kappl proposed an obligatory simplification procedure and mediation. This could be led by well judicial trained Rechtspfleger. The Rechtspfleger should be able to put in place an enforcement order. The number of the law suits can be reduced at the civil courts.

With these measures the justice can overcome the economic crisis.
